Real or legal persons of foreign national is required to file an application with the Land Registry Office to buy an immovable property or to perform the procedures for a preliminary contract for sales.
As stated under the Investment Guide published by the Investment Office of the Presidency of the Republic of Turkey, the below-given documents are required to be submitted to the General Directorate of Land Registry and Cadastre while filing an application with the Land Registry Office:
- Land registration and village/quarter, map section, plot, building
and independent section details of the immovable property,
- ID card with a photograph or passport issued by the country of the foreign
national person (In case of any ID cards or passports issued with any alphabet
other than the Roman alphabet, the certified and notarized translations
thereof are required to be submitted),
- In case of any power of attorney covered under the transaction, a
document for representation (As per the Ministerial Opinion dated 02.02.2019
and numbered 69083781-125.01.01-E.4523418; the expression reading as “to
grant any and all kinds of letter of undertaking and consent required at
the municipalities, land registry offices and any other governmental agencies”
is sufficient to be covered under the power of attorney to provide a
letter of undertaking to ensure that the immovable property may not be
sold for three years.)
- A document showing the current market value of the immovable property,
as issued by the respective municipality,
- Mandatory earthquake insurance policy for buildings,
- One photograph for the seller, and two photographs for the buyer (which
has been taken in the last six months at a size of 6x4 cm).
If either of the parties has not a command of Turkish, a certified interpreter should be present.
The below-given criteria are sought to be performed and fulfilled in order to file a request for issuing an “Eligibility Certificate” with the General Directorate of Land Registry and Cadastre while performing the sales transactions or executing the preliminary contract for sales regarding the immovable property following the application:

There is not any limitation on sales
transactions due to the nature of the immovable property. However; flat
ownership or construction servitude should have been established on the
immovable property to acquire citizenship through preliminary contract for
sales.

There is not any limitation on the
number of immovable properties to be acquired through sales or covered under
the preliminary contract for sales. What matters most here is to ensure that
the total value of the immovable properties is above USD
250,000.00.-, or the equivalent thereof in Turkish Lira or any other foreign currency.

An application should be filed to
obtain an appraisal report for the immovable property on https://webtapu.tkgm.gov.tr/, the
official website of the General Directorate of Land Registry and Cadastre, or
Call Center at ALO-181 if the owner of the immovable property is a citizen of
the Republic of Turkey. The report is deemed valid and applicable within 3
months as of the date of issuance of such report.

Sales transactions may be performed
and the preliminary contract for sales may be executed with any mortgage or
attachment established on the immovable property. However; the respective official
should inform the person of foreign national about such mortgage or attachment,
if any.
5.
An undertaking should be provided
that the immovable property will not be sold, or the preliminary contract for
sales will not be rescinded or transferred within a period of 3 years upon
performance of the sales transaction or execution of the preliminary contract
for sales, and an annotation should be attached for such purpose on the title
deed.
